These general conditions of sale apply, in their version in force at the time of the order (hereinafter GTC), to all orders placed by any person (hereinafter "you") via the site.

You declare that you have read and accepted the T&Cs as well as the rights and obligations arising therefrom before placing your order. The validation of your order therefore implies acceptance of the current T&Cs.

All our deliveries, services and offers are exclusively governed by these GCS, unless expressly agreed otherwise in writing.

We oppose all general or specific conditions contrary to or derogating from these conditions.

The term “consumer” used in these GCS refers to a natural person placing an order which does not fall within his commercial or liberal professional activity.

A “professional” within the meaning of these GCS is a natural or legal person who, when placing an order, acts within the framework and on behalf of his liberal or commercial professional activity. The term "customer" can designate both a consumer and a professional.

The term "working day" within the meaning of these GTC refers to all days of the week with the exception of Saturdays, Sundays and public holidays.

Article 1- Price

Pricing

1 - The prices of the products are indicated in euros all taxes included.

2 - The company Phil - program commando reserves the right to modify its prices at any time and to pass on, if applicable, any change in the rate of VAT in force on the price of the products offered on the site. However, the products will be invoiced on the basis of the rates in force at the time of the order validation.

3 - The prices displayed include participation in processing and shipping costs (in metropolitan France (excluding overseas territories), Andorra and the Principality of Monaco).

Article 2 – Orders and customer account

1 - When you register, you undertake to provide exact and complete information concerning your marital status and your contact details, in particular your e-mail address. The username and password allowing access to our sites are confidential and must not be disclosed to third parties.

2 - You agree to refrain from any disturbance of the website www.phil-programme-commando.myshopify.com and any use, going beyond a simple online consultation, of the data appearing on this site. Any illicit manipulation with a view to obtaining undue payments or other advantages to our detriment or that of other members of the site, notably entails the loss of the right of access to your customer account.

3 - Registration on our sites is free and you can cancel it at any time. It is possible to delete your customer account by contacting us at this email address: motto.contact@gmail.com.

4 - Any deletion of the www.phil-programme-commando.myshopify.com account, for whatever reason, results in the pure and simple deletion of all the customer's personal information.

Any event due to a case of force majeure resulting in a malfunction of the site or server and subject to any interruption or modification in the event of maintenance, does not engage the responsibility of the seller.

Article 3 – Methods of payment

1 - The consumer can place an order on this site and can pay by: Credit card. The price is payable in cash, in full on the day of the order.

2 - No data relating to the means of payment of the customer is collected by the site. Payment is made directly to the site or payment provider receiving payment from the consumer. The invoices will be archived constituting a faithful copy. The computerized registers will be considered by the parties as proof of communications, orders, payment and transactions between the parties.

3 - The customer can place an order on: On the internet. The contractual information is presented in French and will be the subject of a confirmation containing this contractual information at the latest at the time of your order validation.

Article 4 – Validation of the order

The customer declares to have read and accepted these General Conditions of Sale before placing your order. The validation of his order therefore implies acceptance of these general conditions of sale.

Article 5 – Transfer of ownership

Acceptance of the purchase order by the seller automatically entails the transfer of ownership of the products ordered.

Article 6 – Right of withdrawal

1 - In accordance with the legal provisions in force, the customer has a period of 14 days from the sending of the order to exercise his right of withdrawal without having to justify himself.

​

2 - In the event of exercising the right of withdrawal within the period referred to above, only the price of the product(s) purchased will be refunded, the return costs remaining the responsibility of the customer.

​

3 - Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be marketed again in new condition.
In case of depreciation of the product resulting from manipulations other than those to establish the nature, characteristics and proper functioning of the product, the responsibility of the consumer may be engaged. It is understood that the Customer will bear the costs of returning the product in the event of withdrawal, as well as the cost of returning the product if the latter, due to its nature, cannot normally be returned by post. If the previous obligations are not carried out, the consumer will lose his right of withdrawal and the product will be returned to him at his expense.

4 - The request must mention the order concerned by this withdrawal. If the returned package does not reach the seller, it will not be possible to launch an investigation with the postal services to ask them to locate the latter. 5 - In the event of an error on our part, the return must be accompanied by an email containing the invoice for the shipment so that the shipping costs are reimbursed. These will be reimbursed up to 12€. This is why we advise you to send it by letter followed or colissimo. The seller is not required to reimburse the additional costs in the event of the choice of a more expensive delivery method than the delivery method offered on the site. In the event of exercise of the right of withdrawal, Phil-programme-commando will refund the sums paid at the latest within 14 days from the date on which Phil-programme-commando is informed of your decision to withdraw and according to the same means of payment as that used for the order (unless expressly agreed by the customer for a refund using another means of payment). This reimbursement date may be deferred until receipt of the product.

Article 7 – Warranties

1 - In the event of defects in the goods, the customer benefits from the legal guarantees provided for by the legislation in force and must then contact the seller as soon as possible.

2 - The seller authorizes Customers to cancel their orders as long as the seller has not started the delivery process.

Article 8 – Applicable law – Disputes – Processing of complaints – Mediations

This agreement is subject to French law. The language of this contract is French. In the event of a dispute, only the French courts will be competent.

3 - Attribution of jurisdiction:

In the event of difficulty arising during the ordering or delivery of items sold on the site, the customer will first contact the company Phil-programme-commando to seek an amicable solution. The customer has the option of using the conventional mediation procedure or any other alternative method of settling disputes.

Article 9 – Personal data

The personal information and personal data concerning the Customer are necessary for the management of his order and for commercial relations.
They can be transmitted to the companies which contribute to these relations such as those in charge of the execution of the services and orders for their management, execution, processing and payment. A response will then be sent to him within 2 months of receipt of the request.

APPLICABLE RIGHT

The contract formed by the acceptance of these General Conditions of Sale when ordering is subject to French law. The language of this contract is French. In the event of a dispute, the French courts will have sole jurisdiction.
